Understanding Prior Written Notice
Prior written notice is a legal right guaranteed to caregivers/parents of children/youth with
IEPs. Prior written notice requires the school to send written explanations of any proposed
changes in the child’s educational plan. Prior written notice also requires the school to send
a written notice if the school denies a parent request.
Rebecca DiLoreto is the supervising attorney for the Institute for Compassion in Justice Externship and teaches
Family Law, Children, and the Law. She is the Executive Director of the Institute for Compassion in Justice. Prior,
Professor DiLoreto had a twenty-four year career with the Kentucky Department of Public Advocacy (DPA) in
indigent defense. She served as Post Trial Division Director for DPA for ten years and was the first director of the
Lexington Public Defender’s Office. She also served as the Litigation Director for the Children’s Law Center, Inc.
She has represented young people in juvenile, family and circuit court across the Commonwealth.
